Terms and Conditions of Sale - Swivells

Preamble

These Terms and Conditions of Sale (hereinafter the “Terms”) govern all sales made on the website swivells.com between:

(hereinafter “Maison Condamine”)

and any individual making a purchase on the website swivells.com (hereinafter the “Customer”).

The Customer declares that they are legally capable of entering into a contract.

Any order placed on the website implies full acceptance of these Terms.

Maison Condamine reserves the right to modify these Terms at any time. The applicable Terms are those in force at the time the order is placed.

1. Website Accessibility

The website swivells.com is accessible 24/7, except in cases of interruption, whether scheduled or unscheduled, including maintenance operations or force majeure events.

Maison Condamine shall not be held liable for:

  • temporary interruptions of the website,

  • bugs or technical errors,

  • internet network failures or third-party service disruptions.

2. Products

The products offered for sale are described and presented as accurately as possible.

Product photographs and descriptions are provided for informational purposes only and are not contractually binding.

Products are offered subject to availability.

Maison Condamine may occasionally deliver products with slight variations in composition or finishing, provided that their quality and intended use remain unaffected.

3. Prices

All prices displayed on the website are shown in euros (€), including applicable taxes.

Shipping costs are specified before the order is confirmed.

Maison Condamine reserves the right to modify prices at any time. Products are invoiced based on the rates in effect at the time the order is validated.

4. Orders

The Customer selects the desired products and adds them to their cart.

Validation of the order constitutes acceptance of:

  • the displayed prices,

  • the product descriptions,

  • these Terms and Conditions.

An order confirmation email will be sent to the Customer.

Maison Condamine reserves the right to cancel or refuse any order in the event of:

  • a previous dispute with the Customer,

  • suspected fraud,

  • payment issues,

  • obvious pricing or stock errors.

If a product becomes unavailable after the order has been placed, the Customer will be informed as soon as possible and fully refunded.

5. Payment

Payment is due immediately upon ordering.

Accepted payment methods include:

  • Visa,

  • Mastercard,

  • American Express,

  • Discover,

  • Carte Bancaire.

Payments are secured through specialized payment providers.

6. Shipping

Shipping Times

Orders placed before 11:00 AM (GMT+1), Monday to Friday excluding public holidays, are generally shipped the same day.

Orders placed after 11:00 AM are shipped on the next business day.

These timeframes are provided for informational purposes only.

Maison Condamine cannot be held responsible for delays caused by carriers or circumstances beyond its control.

Shipping Address

The Customer is responsible for providing accurate and complete shipping information when placing the order.

If incorrect or incomplete information prevents delivery, reshipping fees may be charged to the Customer.

Parcel Reception

Upon delivery, the Customer is encouraged to verify:

  • the condition of the parcel,

  • the conformity of the received products.

Any issue must be reported within 48 hours to:

Photos may be requested to facilitate the processing of the claim.

7. Returns, Exchanges and Refunds

Return Period

The Customer has 15 days from the delivery date to return all or part of their order.

Returned items must:

  • be unworn,

  • be in their original condition,

  • be returned in their original packaging,

  • retain the protective sole film when applicable.

We recommend trying on shoes on a carpet or soft surface in order to preserve the soles.

Exchanges

European Union and United States

Exchanges are free of charge.

Outside the European Union

Return shipping costs remain the responsibility of the Customer.
The shipping costs for the replacement pair are covered by Maison Condamine.

Refunds

Mainland France and United States

Returns are free of charge.

European Union

A flat €10 return fee contribution will be deducted from the refund.

Outside the European Union

Return shipping costs remain the responsibility of the Customer.

Refunds are processed within a maximum of 14 days after receipt and validation of the returned items, using the original payment method.

Defective Products or Order Errors

In the event of:

  • a defective product,

  • an order preparation error,

  • or a non-compliant item,

Maison Condamine will cover the return shipping costs and offer either an exchange or a full refund.

Customers are invited to contact customer service as soon as possible at:

Unclaimed or Refused Parcels

If a parcel is returned to Maison Condamine because:

  • it was not collected,

  • the shipping address was incorrect,

  • or customs duties were refused,

the original shipping costs as well as any return fees may be deducted from the refund.

8. Customs Duties and Import Taxes

For orders shipped outside the European Union, customs duties or import taxes may be charged by local authorities in the destination country.

These charges remain the responsibility of the Customer.

Maison Condamine has no control over such charges and recommends that Customers contact their local customs office before placing an order.

9. Legal Warranties

Products sold benefit from:

  • the legal warranty of conformity,

  • the warranty against hidden defects,

in accordance with applicable French law.

10. Personal Data

Personal data collected is necessary for order processing and customer relationship management.

Maison Condamine undertakes to process this data confidentially and in compliance with applicable regulations.

11. Force Majeure

Maison Condamine shall not be held liable for any total or partial failure to perform its obligations in cases of force majeure as defined by French law and jurisprudence.

12. Applicable Law - Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal action.

Customers may also use a consumer mediation service free of charge, in accordance with applicable legal provisions.

Failing an amicable agreement, French courts shall have exclusive jurisdiction.
