Terms and Conditions of Sale

Preamble

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern all sales made through the swivells.com website between:

(hereinafter “Maison Condamine”)

and any individual making a purchase through the swivells.com website (hereinafter the “Customer”).

The Customer declares that they are of legal age and have the legal capacity to enter into a contract.

By placing an order through the website, the Customer fully and unconditionally accepts these Terms.

Maison Condamine reserves the right to amend these Terms at any time. The applicable Terms are those in force when the order is placed.

1. Website Availability

The swivells.com website is available 24 hours a day, seven days a week, except in the event of scheduled or unscheduled interruptions, particularly for maintenance purposes or due to force majeure.

Maison Condamine cannot be held liable for:

• temporary interruptions to the website;

• possible bugs or errors;

• failures of the internet network or third-party services.

2. Products

The products offered for sale are described and presented as accurately as possible.

Photographs and descriptions are provided for illustrative purposes only and are not contractually binding.

Products are offered subject to availability.

Maison Condamine may supply a product with minor variations in its materials, composition or finish, provided that these variations do not affect its quality or intended use.

3. Prices

Prices displayed on the website are shown in euros (€) or US dollars ($), depending on the country, and include all applicable taxes.

Shipping costs are specified before the order is confirmed.

Maison Condamine reserves the right to change its prices at any time. Products are charged at the price in effect when the order is confirmed.

4. Orders

The Customer selects the products of their choice and adds them to their shopping cart.

By confirming an order, the Customer accepts:

• the displayed prices;

• the characteristics of the products;

• these Terms.

An order confirmation is sent by email.

Maison Condamine reserves the right to cancel or refuse an order in the event of:

• a previous dispute with the Customer;

• suspected fraud;

• a payment issue;

• an obvious pricing or stock error.

If a product becomes unavailable after an order has been placed, the Customer will be informed as soon as possible and issued a refund.

5. Payment

Payment is due immediately when the order is placed.

The following payment methods are accepted:

• Visa;

• Mastercard;

• American Express;

• Discover;

• Carte Bancaire;

• PayPal.

Payments are processed securely through specialised payment service providers.

6. Delivery

Shipping Times

Orders placed before 11:00 a.m. (GMT+1), Monday to Friday excluding public holidays, are generally shipped on the same day.

Orders placed after 11:00 a.m. are shipped on the following business day.

These timeframes are provided for guidance only.

Maison Condamine cannot be held liable for delays attributable to the shipping carrier or caused by circumstances beyond its control.

Delivery Address

The Customer is responsible for the accuracy of the delivery information provided when placing an order.

If an incorrect or incomplete address prevents delivery, the Customer may be charged additional reshipping costs.

Receipt of the Parcel

Upon receiving the parcel, the Customer is asked to check:

• the condition of the parcel;

• that the products received conform to the order.

Photographs may be requested to help us process the matter.

7. Returns, Exchanges and Refunds

Return Period

The Customer has 15 days from the date of delivery to return all or part of their order.

Returned items must:

• be unworn;

• be in their original condition;

• be returned in their original packaging;

• retain the protective film on the soles, where applicable.

We recommend trying the shoes on a carpet or a piece of fabric to protect the soles.

Exchanges

European Union and United States

Exchanges are free of charge.

Outside the European Union

The Customer is responsible for the return shipping costs.
Maison Condamine will cover the cost of shipping the new pair.

Refunds

Metropolitan France and the United States

Returns are free of charge.

European Union

A flat return shipping fee of €10 will be deducted from the refund.

Outside the European Union

The Customer is responsible for the return shipping costs.

Refunds are issued through the payment method used for the order within a maximum of 14 days after the return has been received and approved.

Defective or Incorrect Products

In the event of:

• a defective item;

• an order preparation error;

• a product that does not conform to the order,

Maison Condamine will cover the return shipping costs and provide either an exchange or a full refund.

The Customer is asked to contact customer service as soon as possible at:

Unclaimed or Refused Parcels

If a parcel is returned to Maison Condamine due to:

• failure to collect the parcel;

• an incorrect address;

• refusal to pay customs duties,

the original shipping costs and any applicable return shipping costs may be deducted from the refund.

8. Customs Duties and Import Taxes

For orders shipped outside the European Union and the United States, customs duties or import taxes may be charged by the local authorities in the destination country.

These charges are the Customer’s responsibility.

Maison Condamine has no control over these charges and recommends that the Customer contact the relevant local authorities before placing an order.

9. Statutory Warranties

The products sold are covered by:

• the statutory guarantee of conformity;

• the warranty against hidden defects;

in accordance with applicable French law.

10. Personal Data

The personal data collected is required to process orders and manage the customer relationship.

Maison Condamine undertakes to process this data confidentially and in accordance with applicable regulations.

11. Force Majeure

Maison Condamine cannot be held liable for the complete or partial failure to perform its obligations in the event of force majeure as defined by French law and case law.

12. Governing Law and Disputes

These Terms are governed by French law.

In the event of a dispute, the parties will seek an amicable resolution before commencing legal proceedings.

The Customer may also use a consumer mediation service free of charge in accordance with applicable law.

If no amicable agreement can be reached, the French courts will have exclusive jurisdiction.
