Preamble
These General Terms and Conditions of Sale govern all relations between Maison Condamine SARL, a company with share capital of €4,000, whose registered office is located at 66 rue de Rome, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 827 719 683 (hereinafter referred to as “Maison Condamine”), and customers of the website swivells.com (hereinafter referred to as “the Customer”) who wish to make a purchase via the website.
The Customer declares that they are legally capable of entering into this contract, meaning that they are of legal age and not under guardianship.
By placing an order, the Customer irrevocably agrees to these Terms and Conditions by clicking on the button “I have read and accept the General Terms and Conditions of Sale.”
Maison Condamine reserves the right to modify these Terms and Conditions at any time, with the version applicable to any given sale being the one published on swivells.com at the time the order is placed.
I. Website Accessibility
swivells.com is an e-commerce website owned by Maison Condamine.
Maison Condamine does not guarantee that the website will be free from anomalies, errors, or bugs, nor that it will operate without interruption or failure. Maison Condamine may freely determine any period of unavailability of the website or its content.
Maison Condamine cannot be held liable for data transmission issues, connection failures, or network unavailability, nor more generally for any event qualified as force majeure by the courts.
II. Validity of Offers
The offers presented on swivells.com are intended for consumers with a delivery address in one of the following countries:
France, Belgium, United Kingdom, Spain, Germany, Luxembourg, Portugal, Austria, Italy, the Netherlands, Ukraine, Switzerland, Estonia, Lithuania, Hungary, Slovakia, Croatia, Czech Republic, Finland, Poland, Malta, Slovenia, Romania, Bulgaria, Sweden, Monaco, Denmark, Ireland, Greece, Latvia, Norway, United States, Australia, Canada, and Hong Kong.
The products displayed on the website are available while stocks last. These indications are updated in real time. However, any updating error shall not incur the liability of Maison Condamine.
In the event of payment being processed for an unavailable item, Maison Condamine undertakes to refund the Customer within 30 days and will notify the Customer by email.
III. Product Presentation
The products displayed on the website are described with the greatest possible accuracy. However, Maison Condamine shall not be held liable for any errors in product descriptions.
Product photographs are for illustrative purposes only and are not contractually binding. Likewise, product descriptions are provided for information purposes only.
Due to supplier constraints, Maison Condamine may deliver an item with a slightly different composition from that described, provided it is of equal or superior quality to the item ordered.
The Customer may also receive a product that has been previously returned by another customer. However, Maison Condamine only accepts returns of unworn and undamaged products, which are verified prior to restocking.
IV. Prices
The prices displayed on the website are final, shown in Euros (€), and governed by French law. They are guaranteed subject to typographical or printing errors.
Prices may be modified at any time without notice. Products are invoiced at the rate in effect at the time the order is confirmed, subject to availability.
V. Orders
To place an order, the Customer must follow the procedure established by Maison Condamine on swivells.com.
The Customer may select as many products as desired, which will be added to their shopping cart. The cart summarizes the selected items along with their prices and applicable fees. The Customer may modify the cart at any time before confirming the order.
Placing an order constitutes irrevocable acceptance of the prices, product descriptions, and these Terms and Conditions.
A confirmation email summarizing the order (products, prices, availability, quantities, etc.) will be sent to the Customer by Maison Condamine. By placing an order, the Customer consents to the use of email for order confirmation and communication.
The invoice will be sent by email to the same address and reflects the applicable prices at the time of ordering. Maison Condamine disclaims responsibility for any input errors made by the Customer.
VI. Payment Terms
All products must be paid for in full at the time of order in Euros (€).
Payments may be made via Carte Bleue, Visa, MasterCard, American Express, or Discover.
The Customer acknowledges that providing their credit card number to Maison Condamine constitutes authorization to debit their account for the total order amount. In the event of payment failure, Maison Condamine will send an order cancellation notice to the Customer’s email address.
The data recorded and retained by Maison Condamine constitute proof of all transactions made.
VII. Refusal to Process an Order
Maison Condamine reserves the right to withdraw any product from the website at any time and to replace or modify any content or information displayed thereon.
Despite its best efforts to satisfy customers, Maison Condamine may refuse to process an order, even after having sent a confirmation email. In such cases, the order will be immediately refunded.
Maison Condamine shall not be held liable for the withdrawal of a product, modification of website content, or refusal to process an order following order confirmation.
VIII. Delivery
Mainland France: Free delivery via Mondial Relay, or €4.90 via Colissimo.
European Union (excluding France): €14.90.
United States: €39 + any customs duties imposed by the U.S. government under the Tariff Act. Maison Condamine collects this amount on behalf of U.S. customers and remits it directly to U.S. customs authorities to prevent unexpected delivery fees.
Rest of the World: €45.
Whenever possible, orders placed before 11:00 a.m. (GMT+1) Monday through Friday (excluding public holidays) are shipped the same day; those placed after 11:00 a.m. are shipped the next business day. These timelines are indicative and subject to payment confirmation.
In the event of a shipping delay unrelated to payment, Maison Condamine undertakes to inform the Customer promptly, either via notice on the website prior to ordering or by email after the order has been placed.
Maison Condamine cannot be held responsible for delays in delivery due to events beyond its control or deemed force majeure.
Maison Condamine’s liability is limited to the refund of the product in the event of delay; no other form of compensation shall be due.
Transport risk transfers to the Customer once the parcel leaves the warehouse. The Customer must inspect the packaging and items upon delivery and immediately report any anomaly to service@swivells.com, including the order number and supporting photos within 48 hours.
The Customer is responsible for ensuring the accuracy and completeness of the delivery address provided. Maison Condamine shall not be held liable for any failure to deliver due to an incorrect or incomplete address. In such cases, reshipping fees shall be borne by the Customer.
IX. Returns and Refunds
If one or more items do not meet the Customer’s expectations, they have 15 days from the delivery date to exercise their right of withdrawal for all or part of the order. The postmark or pickup receipt serves as proof of the start date.
To initiate a return, the Customer must visit our returns portal and follow the instructions below:
Returning a package from within the EU:
Visit our return portal to generate your return label. You can choose between an exchange or a refund.
Returning a package from outside the EU:
Email us at service@swivells.com. We will assist you in organizing the return or exchange.
Once the package is received, we will process the exchange or refund (excluding shipping fees) via the original payment method.
⚠️ Refunds are only possible if the shoes are unworn and still have the protective film on the soles (if applicable).
Return fees:

Exchanges: Free within the European Union.

Returns: Product prices are refunded, but a fee may apply:

Mainland France: free

European Union: €10 deducted from the refund. For exchanges, we cover the shipping of the new pair.

International: €20 deducted from the refund. For exchanges, a €20 contribution applies for the return, and we cover shipping for the new pair.

Refund timing:
Refunds are issued within 15 days after receipt and inspection of returned items and are credited to the original payment method.
Product exchanges:

European Union: Free exchanges via the return portal.

Outside the EU: Contact service@swivells.com. A €20 contribution fee applies for the return, and we cover shipping for the replacement pair.
Defective or incorrect items:
If an item is defective or does not match the order:

The return is free.

The refund is full.
⚠️ After 15 days, the sale is considered final.
Unclaimed or customs-refused packages:
If a package is returned to us because:

it was not collected from a pickup point,

the delivery address was incorrect, or
-
customs fees were refused,
👉 Shipping and any applicable return fees will be deducted from the refund.
X. Visible Defects
In the event of a visible defect, the Customer must submit a claim by email to service@swivells.com within three business days of delivery, clearly specifying the defect and including photos if possible. Otherwise, the claim will not be accepted, and no return will be possible.
The product must be returned in its original packaging, in original condition, new and unworn, accompanied by the original order reference.
Confirmed visible defects entitle the Customer to either a replacement product or a refund within 15 days, at the Customer’s choice.
Failure to comply with the return procedure renders any exchange or refund invalid.
XI. Personal Data
To process orders, Maison Condamine must collect personal data from Customers. This information is strictly confidential and intended solely for use by Maison Condamine.
Maison Condamine reserves the right to collect data through cookies to enhance the personalized customer experience.
XII. Miscellaneous Provisions
If any provision of these Terms and Conditions is found invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid clause shall be replaced by a valid clause that most closely reflects the original intent.
Neither Maison Condamine nor the Customer shall be held liable for failure to perform obligations resulting from force majeure.
XIII. No Waiver
Any failure or delay by Maison Condamine in exercising its rights under these Terms and Conditions shall not constitute a waiver of those rights.
XIV. Governing Law and Jurisdiction
These Terms and Conditions are governed exclusively by French law.
In case of dispute, the Customer and Maison Condamine may seek amicable mediation.
If no amicable resolution is reached, any dispute concerning the interpretation, execution, or termination of a sale shall be submitted to the competent French courts.
